  • Job application process as a pre-contractual or contractual relationship (Art. 9 para. 2 lit. b GDPR) – Where special categories of personal data in the sense of Art. 9 para. 1 GDPR (e.g., health data, such as disability status or ethnic origin) are requested from applicants so that the controller or the data subject may carry out the obligations and exercising specific rights in the field of employment and social security and social protection law, processing shall be based on Art. 9 para. 2 lit. b GDPR, in the case of protection of vital interests of applicants or other persons according to Art. 9 para. 2 lit. c GDPR, or for purposes of preventive or occupational medicine, for the assessment of the working capacity of the employee, medical diagnosis, provision of health or social care or treatment or management of health or social care systems and services according to Art. 9 para. 2 lit. h GDPR. If special categories of data are communicated based on voluntary consent, their processing is carried out on the basis of Art. 9 para. 2 lit. a GDPR.

We process personal data for the duration necessary for the respective purpose or purposes. In the event of longer retention obligations due to legal and other obligations to which we are subject, we restrict processing accordingly.

In accordance with Art. 13 GDPR, we inform you about the legal bases of our data processing. If the legal basis is not mentioned in the privacy policy, the following applies: The legal basis for obtaining consents is Art. 6 para. 1 lit. a and Art. 7 GDPR, the legal basis for processing for the performance of our services and execution of contractual measures as well as responding to inquiries is Art. 6 para. 1 lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 para. 1 lit. f GDPR. Furthermore, we have established procedures to ensure the exercise of data subjects’ rights, deletion of data, and reaction to data risks. Moreover, we consider the protection of personal data already in the development or selection of hardware, software, and procedures, according to the principle of data protection, through technology design and through data protection-friendly default settings.

 

Transmission of Personal Data
